The following Rules and Orders regulating traffic upon the streets nd highways of the Town of North Andover are hereby enacted by the Board �..f Selectmen of the Town of North Andover . ARTICLE I DEFINITIONS— w" For the purpose of these rules and orders , the words and phrases used herein shall have the following meanings except in those instances where the context cl-early indicates a different meaning . - ( a) "Street or Highway ,," The entire wi Beth between property lines of every way open to the use of the publ i c -for purposes of travel . (b) " Roadway , " That portion of a street or highway between the regularly established curb lines or that part , exclusive of shoulders ,, imp❑roved and intended to be used for vehicular traffic. (c) "Lane , " A 1 ongi tudi nal division of a roadway into a strip o'f sufficient width to accommodate the passage of a single line of vehicles . (d) "vehi cl.e , " Every, device i n , upon or by which any person or property - i s or may be trasported or drawn upon a street or highway , except devices w -- moved by human power or used exclusively upon stationary rails or tracks . . f' " i es v the i e ' �e� . Emergency vehi cl e , veh cl f F r Department � F� re Patrol } , pol i ce vehci 1 es , ambul antes and emergency vehi cl es i f .federal , state and muni ci pal depa rtments or pub 1 i c se rvi ce corporati ons when the 1 atter are responding to an emergency in relation to the police or fire departments', (.f "Parking ," The standing of a vehicle , whether - occupied or not , ❑t,her- wi se than temporarily for the purpose of and while actually engaged in leading - or unloading , or in obedience to an officer or traffic c signs or signals , or while making emergency or in obedience to an officer or traffic signs, or signals , or while making emergency repairs Or , if -disabled , while arrangements are being made to move such vehicle , ( g) "Crosswalk ,," That portion of a roadway ordinarily i n cl ude'd within the prolongation or connection of curb lines and property lines at inter- sections , or at any portion of a roadway clearly indicated for pedestrian cross i n-g by lines on the road surface or by other markings or s-i gns . h "Railroad Crossing , Any intersection of ways wi th a rai 1 road ri 9 ht. -of-way , (i ) "Official Traffic Signs All signs , markings and devices , other than signals , not inconsistent with these rules and orders , and which conform to the standards pres ri bed by the Department of Public Works of .the .,Commonwealth of - Massachusetts and placed or erested by authority of a public body or official having jurisdiction for the purpose of guiding , directing , �, warning , or regulating traffic . "Offi cer , 1' For the purpose of these rules .and orders an officer shall be construed to mean any officer , any investigator , examiner or i ns-pector of the Registry of Motor Vehicles , any constable ar special officer, provided he has his bedge of office displayed over his left breast and upon his outer garment . k } "Official Curb Marking ," That portion of a curbing , the painting of �,,.,whi ch has been authorized by the Bard of Selectmen and which has the written approval of the Department .of Public Works , Commonwealth of , Massachusetts , ( 1 ) "Official Street Marking , " Any painted line , legend , marking or marker __❑f any description , painted or placed upon any way which purports to direct or regulate traffic and which has been authorized by the Board of Sel ectm.en ,and which has the written approval of the Department of Public Works , `Commonwealth of Massachusetts . (m) "Commerci al Vehi cl e , " Any vehicle being used in the transportation of goods , wares ❑r merchandi se for commeri cal purp❑s.es . (n ) "Commercial Vehicle , Heavy ," Any commercial vehicle of two and one-- half (2 1/2) tons capacity or over . (o) " Intersection ,, " The area embraced within the extensions of the - lateral curb lines , or, if none , then the lateral boundary lines , of i nt�ersecti ng ways as defined in Section I of Chapter 90 of the General Laws , including divided ways . The rules and regulations herein contained governing and restricting the movement of vehicles at and near intersecting ways shall appply - at any .place along any way at which drivers are to be controlled by traffic control signals whether or not such place is an intersection as herein defined . i ( d) "Vehicle ,, " EVery device i n , upon or by which any person or property is or nay" be transported or drawn upon a highway , i ncl ud- ng bicycles when the provisions of these rules and applicable to them, except other devices moved by human p❑wer� o r used excl us i vel.y upon stationary rails or tracks and devices which derive their power for operation from- stationary overhead wires . • f n ART I, CL E I I AUTHORITY AND DUTIES OF POLICE SECTION 1 . O-FFICERS TO DIRECT -TRAFFIC . It shal 1 be- the duty of off cers `designated by the Chief of Police to enforce the provisions Of those rules wand ❑ rders . Such officers are hereby authorized to direct all traffic either in person or by means of visible or audible signals in conformance with the provisions of these rules and orders ,, provided that in the event of a fire or other emergency to expedite traffic or safeguard pedestrians , officers o'f the Police or Fire Departments may d +* rect traffic , as conditions may require ,, notwithstanding the provisions of these rules and. orders , SECTION 2 . POLICE MAY CLOSE STREETS TEMPORARILY . The Chief of Police is hereby authorized to close temporarily , any street or highway in an impending or existing emergency , or for any lawful assemblage , demonstration or pr❑ceas i on provided there is reasonal be justification for the closing of such street. SECTION 3, POLICE MAY PROHIBIT PARKING TEMPORARILY * The Chief of Police i s hereby authorized to prh i b i t , temporarily , parking on any street ❑r highway or part thereof in an impending + or existing emergency ,, or for a law. f ul assemblage , demos trati on or procession provided there is reasonable justification for such prohi b'i ti on . Vehicles parked in places where parking is prohibited temporarily may be moved by or under the direction of - an officer. 'SECTION 4. EXEMPTIONS . The provi sons of these rules and orders shall • not apply to operaters actually engaged in—work upon a street or highway closed to travel or under construction or repair , to officers when engaged • in the performance of public duties not to drivers of emergency vehicles ff while Operating in an emergency and in performance of public dutl es when the nature of the work of any ❑f these necessitates a •departure from any part of these rules and orders . These exemptions shall , however , protect th-e driver of - any vehicle from the consequences of a reckless disregard of the safety of others . JI SECTION 5 . CHIEF OF POL•I CE TO MAKE ANNUAL ACCIDENT REPORT ,' •The Chi of of Pol i ce steal 1 make an annual report concerning th-e acci dent si tuation in the town , accompanied by his recommendations ,, SECTION 6 . POLICE TO KEEP A DRIVER FILE . (a ) The police shall keep a record of all operators involved in acc "dent•s within the mu n i ci pa-1 i ty . (b ) The Chief of Police shall report to the Registrar- of Motor Vehicles such operators as are found ro be constant vi ol. ators of thes-e regulations , O SUBMIT T EPO SECTION � . POLICET ANNUAL TRAFFIC SAFETY REPORT .. The Chief of Police shall include in his report to the Board of Selectmen . ( 1 ) The number of operators reported to the Registrar of Motor Vehi cles , (2) He shall report other pertinent data on safety aci tivi es -accompained. by his recommendati ons . `(3 } The plans and recommendations for future traffic safety activities., ARTICLE III T-RAFFIC SIGNS , SIGNALS , MARKINGS AND ZONES .: SECTION 1 . TRAFFIC SIGNS AND SIGNALS * a} The Board of Selectmen is hereby authorized an as to those signs and -...A gnat s -required hereunder it shall be its duty , to place and maintain or cause to be placed and maintained all official traffic signs , signals , marking and safety zones . All signs , signals , * markings and safety zones Shall conform to the .standards as preseri bed by the Department of Public Works of the Commonwealth of Massachusetts . } S e c t i o n s 2 and 3 of Arti c1 e I I and S e c t i on 2 of Arti cl e V re a t 1 ng to parki n-g , "and Article VI I , Section 12 relating to the operation of heavy commeri ca 1 vehi cl e--" shall be effective only du.ri ng such time as a sufficient number of offi c-i al signs are erected and maintained in each, block designating the provisions of such sections and located so as to be easily visible to approaching dirivers . (c ) Sections relating to one-way streets shall be effe.cti ve only during such time as a sufficient number of official signs are created and maintained at each of the exits for each one--gray street , so that at least one sign will be clearly visible for a distance of at least seventy-five, (75 ) - feet to drivers approaching such an exit . SECTION 2 .- DISPLAY OF - UNAUTHORIZED SIGNS , SIGNALS ANQ MARKINGS PROHIBITE Any person who wilfully defaces , injures , moves ,, obstructs or interferes with any officials traffic s i n , signal or marking shall be liable to a penalty p+ exceeding twenty ( 20 dollars for each and every offence . SECTION 4. OBEDIENCE TO TRAFFIC SIGNS AND SIGNALS . -'No driver of any vehicle or of any street car shall disobey the instructions of any official traffic cont.ro..1 si g.na-1 , sign , marking , marker or legend , unless otherwise directed .by a pol.i ce officer . A R T I C L E V PARKING SECTION 1 , GENERAL PROHIBITIONS . No person shall park a vehicle n any of the following pl aces and vehicles found parked in violation of the provisions of Schedu'l a .-I : may be moved by or under the direction of an officer and at the expense of the owner to a place where parking i s permi t,ted . ( a) within an intersection . b } Upon any sidewalk . c Upon any crosswalk . d Upon the roadway in a rural or sparsely settled district . (e ) Upon a roadway where parking is permitted unless 'both wheels on the right side of the vehicle are within twelve ( 12) inches of the curb or edge of the roadway , except upon those streets which are designated as one -way streets , On such one-way streets vehicles shall be parked in the direction in which said vehicle is moving and with both wheels within twelve ( 12 ). inches of the curb . This shall not apply to streets or parts of streets where angle parking is required by these regulations , (f) Upon any roadway where the parkin of a vehicle will not leave a clear and unobstructed lane at least ten ( 10 feet wide for passing traffic . (g) Upon any street or. highway within ten ( 10 ) feet of a fire hydrant . (h ) Upon or in front of any private road or driveway . 1 U on an street or hi hway within twenty (2O) feet of an Intersecting ( i ) p Y 9 way ,. except alleys . SECTION 2 . PROHIBITED ON CERTAIN STREETS ,, , No person , except in the event of an emergency shall park or 1 eave-- unattended at any time on the streets listed in Schedule I attached hereto , SECTION 3. NIGHT PARKING : No driver shall park. or stand any commercial vehicle or trail- or having a capacity of one ( 1 ) ton or over for more than one ( 1 ) hour between 12 :01 A. M. and S :DO A. M. on any day or at any time on Sunday on -any part of any street , way , highway , road or parkway under the control of the town 'here parking or standing a vehicle i s n,ot otherwise prohibited , provided that this regulation shall not apply during the actual 1 ❑adi*ng or unl oadi n-g of materials . Date of Passage : August 3 , 197011 J - ARTICLE VI ADVERTISING SIGNS , DISPLAY AND STORAGE OF MATERIALS IN STREETS �-� SECTION 1 . USING VEHICLE FOR SOLE PURPOSE OF DISPLAYING ADVERTISING PROHIBITED. No person shall operate or park a vehicles on any street or highway for the sole purpose of displaying advertising signs .SECTION 2 , ADVERTISING SIGNS ON SIDEWALKS OR STREETS MUST HAVE PERMITS No person s hal 1 erect or cause to be erected upon or above any town s i de. wa.l k , street or hi ghway any advertising sign or device which prefects into or ever the sidewalk street or highway more than six (6 ) i nches unl ess a � permit authorizing the erection of such sign or device - has been issued by the Board of Selectmen and is In effect . After five days ' notice illegal Y. advert.i si ng signs or devices may be removed by or under the direction of -a police officer and at the expense of the owner ._ Any .person violating the - provisions of this section shall be subject to a fine not exceeding five dollars for each day such sign or device has remained after the expiration of the fi ve days of noti ce. SECTION 3 , PLACING OF STRUCTURES OR PROPERTY IN STREETS PROHIBITED . (a) No person shall place , erect or cause to be placed or erected within an3 sidewalk , street or highway any fixture or structure unless a permit , issued by the Board of Selectmen , in the case of town ways or by the Department ❑f Pub l i:c works , Commonwealth of -Massachusetts , in the case ❑f state Hi ghways , authorizing such placing or erection has been granted and is in effect. (b ) No person , other than one employed directly or indirectly by this town or by the Commonwealth of -Massachusetts and wh-i l e in the performance of ;t necessary public duties , shall at any time place or leave in any sidewalk , street or highway for the purpose of displaying merchandise unless s a per - mi t -issued by the Board of Selectmen In the case ❑f town ways or by the Department of Public Works in the . case case of state highways ,, authorizing n the . g use ❑f the sidewalk , street or highway, has been graft-ted and is in effect , except as may 'be necessary for t-he reasonable and expeditious loading ❑r u-nl oadi ng of any such article , material , merchandise , cart or vehicle , provided , .however , that such property shall never be left s❑ as to obstruct . the free passage of pedestri ans ' or vehicular travel . ( c) Any such fixture , structure or property as referred to i.n. this section which has been erected ,, placed or left illegally in any street , highway or sidewalk may be roved by or under the direction of an officer and at the owner ' s expense . SECTION 4 , DEPOSIT , BOND OR INSURANCE POLI C-Y MAY .BE REQURI ED FOR PRIVILEGE OF USING STREET FOR SPECIAL PURPOSES , The Bvar"d'. *or officer issuing permits for such use ❑f sidewalks , streets or highways as' are described in the two previous sections -may in its or his `- discretion when occasion justifies demand a suitable cash deposit , surety bond or insurance indemnity policy to save the town or the Commonwealth of Massachusetts harmless from all liability of any nature , whatsoever caused directly or indirectly by such use of the sidewalk ,, street or high- way . ARTICLE VI I OPERATION OF VEHICLES SECTION l . DRIVE WITHIN MARKED LANES . When any roadway has been di vi ded i nto 1 anes , a dri ver of a vehicl a shal 1 . drive so as to be entirely within a- single lane and 'shall not move from the lane in which he is driving until he has first , ascertained if such move- ment can be made with safety . SECTION 2 . USE RIGHT LANE . Upon a l l roadways the d ri ver of a vehicle shall d i rve In the lane nearest the right side of the roadway when said lane is avai I a 1 be for travel except + when overtaking another vehicle or when preparing for a left turn . SECTION 3. OVERTAKE ONLY WHEN THERE IS A SPACE AHEAD , The driver of a vehicle shall not overtake and pass a vehci 1 e proceeding in the same direction unless there i s sufficient clear space ahead on the ri ght s i de of the roadway to permit the -overtaking to be completed without impeding the safe operation of any vehicle ahead . SECTION .4. DRIVER TO GIVE WAY TO OVERTAKING VEHICLE , The driver of a vehi cl a when about to be overtaken and passed by another vehicle approaching from the' rear- shall give way to the right in favor of the oevertaki ng vehicle , � on suitable and s udi bl e signal being 'gi ven ' by the driver of the overtaking vehicle , and shall not 'increase the speed of his vehicle until completely passed by the overtaking vehicle . SECTION 6. OBSTRUTI NG TRAFFIC. II (a ) No person shall drive in such a manner as to obstruct unnecessarily the normal movement of traffic upon any street or highway . Officers are hereby a uthroi zed to require any driver who fails to comply with this section to drive to the side of the roadway and wait uni tl such traffic as has been delayed has passed , (b ) . No dri ver shal 1 enter an i ntersection or a marked crosswal k unless there is sufficient space on the other side of the intersection or cross - walk and o.n the right half of the roadway .to, accommodate the , veh'i .cl a he is- operating without obstructing the passage of other vehicles or pede- strians notwithstanding any traffic control signal indication to proceed . SECTION 6. FOLLOWING TOO CLOSELY . The d.ri ver of a vehicle shall not follow another vehicle more closely then is reasonable and prudent , having due regard to the speed of such vehicle and the t.raffi c upon any condi ti.on of the street or highway , SECTION 7 . SLOW VEHICLES TO STAY , 2DO FEET APART . Upon roadways less than twenty-seven (27 ) feet wide -and upon which vehi cul a traffic is permitted to operate in both directions the driver of any s 1-ow moving vehicle when traveling outside of a business or residential district shall not follow another slow moving vehicle within two hundred ( 200 ) feet , but thi' s shall not be construed to prevent such slow moving vehicle from overtaking and passing another slow moving vehicle . This section shall, not apply to funerals or other lawful processions '. SECTION 8, CARE IN STARTING , STOPPING , TURNING OR BACKING , The driver of any vehicle before starting , stopping ,, turning from a direct line or backing shall first see , that such movement can be made in safety . If the operation of another vehicle should be affected , by a stopping or l , SECTION 8. ( con ' t ). turning movement , the driver of such vehicle shall be given a plainly visible signal , as required by the following section , SECTION 9 . STOPPING AND TURNING SIGNALS . ).(a) be given sufficient time in advance of Any signal herein required shall , the movemetn indicated to give ample warn i ng to any person who may be affected by said movement , and shall be given either by means of the hand and arm in the manner specified., or by a suitable mechanical or electrical device , except that when a vehicle is so constructed or loaded as to prevent the hand and arm signal from being made or from being visible both to the fron and rear the signal shall be given by a -suitable device . .. (b ) Hand and arm signals , as required herein sh-al l be made as follows 1 . An intention to stop shall be extending t-he arm horisontal ly to the left of and beyond the side of the vehicle . 2 . An intention to turn to the left shall be indicated by extending the arm horizontally to the left of and beyond the side of the vehi.cl e , and by pointing to the left with the index finger. 3 . An intention to turn to the right shall be indicated by extending the arm horizontal ly ' to the 'left of and beyond the side of the vehicle , and, and by moving 'the hand in a circle . SECTION 10 . OBEDIENCE TO ISOLATED STOP SIGNS , Every driver of a vehicle , railway car or other conveyances approaching an intersection of ways where there exists facing him an -official sign , bear. i n g the word "stop" and authorized by this section $ said sign having apart .,from this ,,regul ati ❑n , the written approval of the Department of Public Works ,;Commonwea t th of Massachusetts ,, and such approval -being in effect , shal l , ..-," before proceeding through the intersection , bring such vehicle , railway car or other conveyance to a complete stop at such po.i nt as may be a place between the said "stop" sign and the nearer line of the street intersection . In the ca s-e, o f . a line or two or more vehicles a.pp.ro►a ch i n g such "stop" s i gn , the drivers - o f the second and third vehicles in line in any group shall not be requ i red to stop more than once before proceeding through the intersection . This section shall not apply when the traffic i s otherwise directed by an .officer or by a lawful traffic regulating sign , signal or device . In accordance with the foregoing , the erection and maintenance of an offi ci a 41 "stop " sign or signs are authroi zed so as to face drivers at 1 ocations list in Schedule Iv attached hereto ; SECTION 1 1 . NO DRIVING ON SIDEWALKS The dri ver of a vehi cl e s ha 11 not dri ve upon any s i dewal k except a t a permanent or -temporary driveway . SECTION 12 . OPE RATI O*N OF HEAVE' COMMERCIAL VEHICLES . The use and operation of heavy commerical - vehicles having a carrying capaci t of two and one-half ( 2 1 /2) tons or over are restricted on the streets or parts of streets , listed in Schedule V attached hereto , in the manner o.utl i n and during the period of times set forth . Exemptions : Part 1 of this Section shall not apply to heavy commercial vehi - cles going o or coming from places aces upon said streets for the 9 g t purpose of make ng deliveries ❑f goods , wares or merchandise to or similar collection from abutting land or buildings , or to adjoining streets or ways to which access cannot otherwise be gained ; or to vehicles used in connection with n' Y SECTION , 1 (c.on" t) OPE RATION OF HEAVY . SECTION 13 . D.BEDIENCE TO TRAFFIC CONTROL SIGNALS . ' Colors and arrow indications in traffic control signals shall have the commands ascribed - to them in this section ,, and no other meanings , and every driver of a vehicle , railway car or other conveyance shall comply therewith , except when otherwise directed by an officer or be a lawful traffic regulating sign (other than a "stop " sign ) , signal or device . In no case shall a driver enter or proceed through an intersection without due regard to the safety of other pe-rsons within the intersection , regard- less of what indications may be given by traffic control signals , a } GREEN : Wh i 1 e the green 1 ens i s i 11 umi n ated , 'dri vers faci ng the s i gnat may proceed through the intersection , but shall yield the right of way to pedestrians and vehicles lawfully within a crosswalk or the intersection at the time such a signal was exhibited. Drivers of vehicles making a right or left turn shall yield the right of way to ped-estri ans crossing with. the flow of traffic . b } RIGHT , LEFT AND VERTICAL CAL GREEN ARROWS When a right green arrow is i l 1 umi me ri ve rs fa ci ng say s� gna may turn right . When a left arrow is ill umi nt-ed , drivers facing said signal may turn left . When a vertical green arrow is ill umi_n ated , drivers facing said signal may go straight ahead . when a green arrow i s exhibited together with a red or a yellow lens , drivers may enter the intersection to make the movement pe�rmi tted by the arrow , but shall yl el d the right of way to � vehicles and pedestrians proceeding from another direction on a green indication . ' SECTION 14 . OPERATION AT UNDER OR �OV.ERPASSES AND AT INTERSECTION WITH ISLANDS . At any junction or crossing of ways wh.er.e the roadway grades have been separated and where the ways -are connected by ramps and at intersections of ways in who ch there are traffic islands , drivers of vehi cl e-s shall pro-ceed only as indicated by official signs , signals or marki ngs . SECTION 15 . RESTRICTED TURNING MOVEMENTS : (Schedule VI ) The streets where the turning movements are restricted ' are listed in Schedule VI attached hereto , . ARTICLE VI I I ONE-WAY STREETS 5 r SECTION 1 . ONE-WAY STREETS , Upon the streets or parts of streets listed in Schedule III attached hereto , vehicular traffic shall move only in the direction indicated , Any violation of this Order shall be punished by a fine of twenty dollars , (or a specific sum less than twenty dollars . Sri _ ARTICLE IX ACCIDENT REPORTS , RESPONSIBILITY , PENALITIES AND APPEALS ..,� SECTION 1 . DRIVERS -MUST REPORT ACCIDENTS . The driver of any vehicle involved �i n an accident resulting in the injury -- or death of any person or property damage to an apperant total extent of twenty-five ( 25) dollars or more shall within twenty-four hours make a full and complete report in writing of -such accident - to the polki ce headquarters in this town . A driver who has been incapacitated as a result of s uc-h accident and to such extent as to make reporting impossible or unfavorable f� to his recovery , shall not be required to report such accident until he has recovered suffiei ently to be able to do so . The report shall be made - on a foam furnished by the police department , 'copies of which shall be avai 1 abe at the police station, Compliance with this section , however , s ha not relieve such driver from the additional responsibility of reporting to the Registrar of Motor vehi cl ces any accident in which a person is killed or injured . SECTION 2 . OWNER PRIMA FACIE RESPONSIBLE FOR VIOLATIONS , If any vehicle i s found upon any street or highway -i-n violation of any provisions of these rules and orders and the identity of- the driver cannot be determined , the owner or , the person in whose name such vehicle is registered , sh-al1 be hold prima facie responsible for such violations , SECTION 3. PENALTY . Except as otherwise provided by statute , or by any commission , department or other body authori zed by law to -impose penalties for violations of rules -, regulati ons and orders governing the use and operation of .vehicles , any )Person convicted or violating any of the prevsi❑ns of the foregoing rules a regulations shall be punished by a fine -of not more than $2 , 00 for the firs effense and not more than $20 , 00 for each subsequent offence of a like nature committed during any period of one year unless otherwise herein - p-ry vi ded.. SECTION 4 . REPEAL , These rules are adopted with the intent that each of them shall have force and effect separately and independently of every other except insofar as by express reference or necessary implication any rule or'-any part of a rul is made dopeni ent upon another rule or part thereof. The provisions of these rules so are as they are the same i n e f fect as t-hes of any existing rules , orders or regulations heretofore made by the Sel ectm of North Andover relative to or in connection with. official signs , 1 i ghts , markings , signal systems or devices shall be construed as a continuation . thereof , but all other existing rules , orders and regulations so -made fo'r t reg'ul a ti on of vehicles are hereby expressly repealed . Thi s repeal =however , shall not affect any punishment or penalty imposed or any complaint or prosecution pending . at � the time of the passage hereof for an offense commit under any of the said rules , orders or regulations hereby repealed , Passed by the Board of Selectmen' May 9 , 1938 ARTH UR A , THOMSON FRANK H.I LTON JAMES P .
